Privacy Policy

This English version is provided for your convenience. Only the German version is legally binding.

1. Information on the collection of personal data and contact details of the controller

We are pleased that you are visiting our website and thank you for your interest. Below we inform you about how we handle your personal data when you use our website. Personal data is any data by which you can be personally identified.

The controller responsible for data processing on this website within the meaning of the General Data Protection Regulation (GDPR) is MK Antriebstechnik GmbH, Pionierstraße 3a, 77694 Kehl, Germany. The controller is the natural or legal person who, alone or jointly with others, determines the purposes and means of the processing of personal data.

For security reasons and to protect the transmission of personal data and other confidential content (e.g. orders or enquiries to the controller), this website uses SSL or TLS encryption. You can recognise an encrypted connection by the character string “https://” and the padlock symbol in your browser’s address bar.

2. Data collected when you visit our website

If you use our website for information purposes only, i.e. if you do not register or otherwise provide us with information, we only collect the data that your browser transmits to our server (so-called “server log files”). When you visit our website, we collect the following data, which is technically necessary for us to display the website to you:

  • the page of our website you visited
  • date and time of access
  • amount of data sent in bytes
  • source/referrer from which you reached the page
  • browser used
  • operating system used
  • IP address used (if applicable, in anonymised form)

Processing is carried out in accordance with Art. 6 (1) (f) GDPR on the basis of our legitimate interest in improving the stability and functionality of our website. The data is not passed on or used in any other way. However, we reserve the right to check the server log files subsequently if there are specific indications of unlawful use.

3. Cookies

To make visiting our website attractive and to enable the use of certain functions, we use so-called cookies on various pages. These are small text files that are stored on your device. Some of the cookies we use are deleted at the end of the browser session, i.e. after you close your browser (so-called session cookies). Other cookies remain on your device and enable us or our partner companies (third-party cookies) to recognise your browser on your next visit (persistent cookies). When cookies are set, they collect and process certain user information such as browser and location data as well as IP address values to an individual extent. Persistent cookies are deleted automatically after a specified period, which may differ depending on the cookie.

Where personal data is also processed by individual cookies implemented by us, processing is carried out either in accordance with Art. 6 (1) (b) GDPR for the performance of the contract or in accordance with Art. 6 (1) (f) GDPR to safeguard our legitimate interests in the best possible functionality of the website and a customer-friendly and effective design of the page visit.

We may work with advertising partners who help us to make our website more interesting for you. For this purpose, cookies from partner companies are also stored on your hard drive when you visit our website (third-party cookies). If we work with such advertising partners, you will be informed individually and separately about the use of such cookies and the scope of the information collected in the following paragraphs.

Please note that you can set your browser to inform you when cookies are set and decide individually whether to accept them, or to exclude the acceptance of cookies in certain cases or in general. Each browser manages cookie settings differently. This is described in the help menu of each browser, which explains how you can change your cookie settings. You can find these for the respective browsers under the following links:

Please note that the functionality of our website may be restricted if cookies are not accepted.

4. Contacting us

When you contact us (e.g. via the contact form or by e-mail), personal data is collected. The data collected when using a contact form can be seen from the respective form. This data is stored and used exclusively for the purpose of responding to your request or for establishing contact and the associated technical administration. The legal basis for processing this data is our legitimate interest in responding to your request in accordance with Art. 6 (1) (f) GDPR. If your enquiry is aimed at concluding a contract, the additional legal basis for processing is Art. 6 (1) (b) GDPR. Your data will be deleted once your enquiry has been dealt with in full. This is the case when it can be inferred from the circumstances that the matter in question has been conclusively resolved and provided there are no statutory retention obligations to the contrary.

4a. Embedded YouTube videos

We embed videos from the YouTube platform on our website. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

We use YouTube in privacy-enhanced mode (youtube-nocookie.com). The videos are only loaded when you click on the respective preview image. Before that, no data is transmitted to YouTube.

As soon as you start a video, a connection to YouTube’s servers is established. YouTube thereby learns which of our pages you have visited; in particular, your IP address and technical information about your browser are transmitted. YouTube may also store cookies or similar technologies on your device. If you are logged in to your YouTube or Google account, YouTube can assign your browsing behaviour to your personal profile. You can prevent this by logging out beforehand. A transfer of data to the USA cannot be ruled out.

The legal basis for processing is your consent in accordance with Art. 6 (1) (a) GDPR and Section 25 (1) of the German Telecommunications Digital Services Data Protection Act (TDDDG), which you give by clicking on the video. You can withdraw this consent at any time with effect for the future by not starting any further videos and deleting stored cookies in your browser.

Further information on how your data is handled can be found in Google’s privacy policy: policies.google.com/privacy

5. Rights of the data subject

5.1 Applicable data protection law grants you the following data subject rights (rights of access and intervention) vis-à-vis the controller with regard to the processing of your personal data; for the respective conditions of exercise, please refer to the legal basis stated:

  • right of access pursuant to Art. 15 GDPR;
  • right to rectification pursuant to Art. 16 GDPR;
  • right to erasure pursuant to Art. 17 GDPR;
  • right to restriction of processing pursuant to Art. 18 GDPR;
  • right to notification pursuant to Art. 19 GDPR;
  • right to data portability pursuant to Art. 20 GDPR;
  • right to withdraw consent pursuant to Art. 7 (3) GDPR;
  • right to lodge a complaint pursuant to Art. 77 GDPR.

5.2 RIGHT TO OBJECT

IF WE PROCESS YOUR PERSONAL DATA ON THE BASIS OF OUR OVERRIDING LEGITIMATE INTEREST WITHIN THE FRAMEWORK OF A BALANCING OF INTERESTS, YOU HAVE THE RIGHT TO OBJECT TO THIS PROCESSING AT ANY TIME WITH EFFECT FOR THE FUTURE ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION.

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL STOP PROCESSING THE DATA CONCERNED. HOWEVER, WE RESERVE THE RIGHT TO CONTINUE PROCESSING IF WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, FUNDAMENTAL RIGHTS AND FREEDOMS, OR IF THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS.

IF WE PROCESS YOUR PERSONAL DATA FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH MARKETING. YOU CAN EXERCISE THE OBJECTION AS DESCRIBED ABOVE. IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL STOP PROCESSING THE DATA CONCERNED FOR DIRECT MARKETING PURPOSES.

6. Duration of storage of personal data

The duration of storage of personal data is determined by the respective legal basis, the purpose of processing and – where relevant – the respective statutory retention period (e.g. retention periods under commercial and tax law).

When personal data is processed on the basis of express consent in accordance with Art. 6 (1) (a) GDPR, this data is stored until the data subject withdraws their consent.

If there are statutory retention periods for data processed within the framework of legal or quasi-legal obligations on the basis of Art. 6 (1) (b) GDPR, this data is routinely deleted after the retention periods have expired, provided that it is no longer required for the performance or initiation of a contract and/or we no longer have a legitimate interest in continuing to store it.

When personal data is processed on the basis of Art. 6 (1) (f) GDPR, this data is stored until the data subject exercises their right to object pursuant to Art. 21 (1) GDPR, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or the processing serves the establishment, exercise or defence of legal claims.

When personal data is processed for direct marketing purposes on the basis of Art. 6 (1) (f) GDPR, this data is stored until the data subject exercises their right to object pursuant to Art. 21 (2) GDPR.

Unless otherwise stated in the other information in this policy on specific processing situations, stored personal data will otherwise be deleted when it is no longer necessary for the purposes for which it was collected or otherwise processed.
